Welcome to Ya Llegué. By downloading, installing, or using the Ya Llegué application (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the App.

1. Description of Service

Ya Llegué is an employee time-tracking application that allows employees to clock in and out of work using GPS verification, and allows employers to manage timecards, job sites, and payroll reports.

2. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you meet this requirement.

3. Account Registration

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You are responsible for all activity that occurs under your account.
You must notify us immediately if you suspect unauthorized access to your account.

4. Subscriptions and Payments

Ya Llegué offers a free tier (up to 2 employees) and paid subscription plans (Basic, Pro, Business) for larger teams.
Paid subscriptions are billed monthly through the Apple App Store or Google Play Store.
Payment is charged to your App Store or Google Play account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription through your device’s App Store or Google Play settings.
Refunds are handled by Apple or Google in accordance with their respective refund policies.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to gain unauthorized access to other accounts or systems
Falsify time entries or location data
Reverse engineer, decompile, or disassemble the App
Use the App to harass, abuse, or harm others
Interfere with or disrupt the operation of the App

6. Employer and Employee Responsibilities

Employers are responsible for ensuring their use of the App complies with applicable labor laws, including wage and hour regulations, in their jurisdiction.
Employees should clock in and out accurately and honestly.
Ya Llegué is a time-tracking tool and does not provide legal, tax, or payroll compliance advice.

7. Location Services

The App uses GPS location data to verify employee presence at job sites during clock-in and clock-out. Location data is collected only at these specific moments and is not tracked continuously. You may revoke location permissions at any time, but this will prevent clock-in/out functionality.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Intellectual Property

The App and all associated content, features, and functionality are owned by Ya Llegué LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Ya Llegué LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or payroll errors.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. You may stop using the App and delete your account at any time.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify users of material changes through the App or by email.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
